Terms and Conditions for Supply of Audio CDs of third-party songs |
1. | What we provide |
| Audio track(s) on a CD. |
| The CD is delivered by first class post in the UK and by airmail to other countries. |
| |
2. | On payment of the requested fee, the Licensee named in the order confirmation is licensed to:- |
| Use the track(s) supplied on the CD(s) listed in the order confirmation for rehearsal or live public performance. |
| |
3. | This licence is limited to use of each supplied backing track as a backing track. |
| This does not constitute a licence for public performance of the song(s). Licences to perform the song(s) should be obtained from the appropriate rights holder (for example, the Performing Right Society in the UK) |
| (Copyright law distinguishes between a recording and public use of that recording. If you buy a CD, you do not have the right to broadcast the songs on the CD.) |
| (The copyright holder of a song - usually the song writer - collects royalties when recordings of that song are made, and when it is performed in public. The supplier has purchased recording rights via the MCPS. Public performance rights are needed if you wish to perform the song in public.) |
| |
4. | The Licensee shall not:- |
| Transfer the licence to a third party. (In the event of a name change the licensee must advise Lazy Bee Scripts and request that an amended license is granted and until such amended licenses are granted, use of the backing track(s) is forbidden.) |
| Alter, modify, publish, distribute, sell, broadcast, transmit, create derivative works from, or edit any content of the backing track(s) covered by this licence without the expressed written permission of Lazy Bee Scripts and the supplier of the backing tracks. Any such activity constitutes copyright infringement which will result in termination of service and possible legal action. |
| |
5. | Rights of the Supplier:- |
| The original audio master of the arrangement remains the property of the supplier. The supplier retains the right to remove permission of use if the supplier judges that these terms and conditions have been abused. |
| The Supplier shall be credited in the programme of any show in which the CD is used for backing or for any other purpose. |
| |
6. | Returns and Refunds |
| If you buy merchandise by mistake, or if we supply the wrong merchandise, you have the right to refund and/or replacement provided that you notify Lazy Bee Scripts within 7 days of your order being accepted by us. If you wish to request a refund or replacement, please contact us before taking any other action. (For example, it is easier and cheaper for us to process a refund than if you cancel a transaction with your credit card company.) See our Contact page for contact details. Please quote your order number in any correspondence. |
| CDs purchased in error must be returned in their supplied condition in order to qualify for a refund. |
| If you disagree with any of these terms and conditions, you must return the CD to Lazy Bee Scripts. |
| If a CD is returned, all license to use the material on the CD is cancelled. |
